How do we attract more applicants MAC makeup under-represented groups into the workplace? With the best will in the world you can't go out and advertise, for example, "women to fulfil senior roles" or "mature workers required". This is positive discrimination and in the uk it would constitute direct discrimination, unless the requirement to be female or over a certain age is a genuine occupational requirement. GORs are construed very narrowly. In the us positive discrimination is lawful. That is notCheap MAC Makeupe case in the uk, although there is a House of Lords decision which effectively allows positive discrimination in the case of an existing employee who becomes disabled; but otherwise we are rather more democratic and try to ensure that people get opportunities to be selected based on their merits. In the case of Archibald v Fife Council [2004], a road sweeper became disabled and was not able to do her original job. She re-trained so that she could do a more sedentary role. She applied for 100 jobs within the Council. She could have done these jobs, but she was never the best candidate. In the end she was dismissed on the grounds that she was not capable of doing her original job and had not secured a suitable alternative role. She argued that by failing to fast-track her to a job she could do, MAC Cosmetics Wholesale Council had failed to make reasonable adjustments, a legal requirement under the disability legislation. The house of Lords agreed with her, effectively agreeing that if she qualified for the role, she should be selected because of her disability.
